Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern access to ml-star.com, requests for information, product registration, quotations, purchases, consultations, demonstrations, partner applications and other transactions with ML-Creative Group LLC, doing business as ML-Star (“ML-Star,” “we,” “us,” or “our”). By using the site, submitting a form, accepting a quote or placing an order, you agree to these Terms and any additional written terms presented for the transaction.

2. Eligibility and Authority

You must be legally capable of entering a binding agreement. If you act for a business or other organization, you represent that you have authority to bind it. You must provide accurate and current information.

3. Product Journeys

ML-Star offers Professional Systems and Home Devices. Professional Systems may require consultation, qualification, a written quote, installation planning, training or other commercial terms. Home Devices may be offered for personal use or approved professional retail. Product categorization does not create a regulatory classification or guarantee suitability for every user or setting.

4. Product Information and Regulatory Statements

We seek to describe products accurately, but images, colors, dimensions, packaging, specifications, included items and availability may change. Product-specific regulatory status is stated only where supported by approved records. Establishment registration, device listing, classification or exemption does not by itself mean FDA approval. No portfolio-wide regulatory statement applies to every ML-Star product. In case of conflict, the approved labeling, user guide, written order and applicable law control.

5. No Medical Advice or Guaranteed Result

Site content is educational and commercial information, not medical advice, diagnosis or treatment. Follow the user guide, safety information and contraindications. Consult an appropriate licensed professional where needed. ML-Star does not guarantee a health, therapeutic, aesthetic, clinical, financial, utilization, revenue or return-on-investment result.

6. Prices, Quotes and Promotions

Displayed prices are in U.S. dollars unless stated otherwise and may change prospectively. Taxes, shipping, freight, installation, training and other charges may be additional. A quote is valid only for its stated period. Promotions and coupon codes may have separate terms, cannot be combined unless stated, and do not reduce mandatory warranty or statutory rights.

7. Orders and Acceptance

An order is an offer to purchase and is not accepted until ML-Star issues written confirmation or fulfills the order. We may decline, limit or cancel an order for availability, pricing error, suspected fraud, regulatory, compliance, geographic, reseller or other legitimate reasons. If we cancel after collecting payment, we will refund the canceled amount.

8. Payment, Taxes and Financing

You authorize the payment method for all disclosed charges. You are responsible for applicable taxes except taxes on our income. Payment processing may be provided by third parties. Financing, installment or credit arrangements are governed by the provider’s separate terms.

9. Professional Systems

Professional Systems may be subject to a proposal, site review, deposit, production allocation, delivery requirements, installation scope, training scope, acceptance documentation, maintenance requirements and commercial-use conditions. The signed quote, invoice, order form or contract supplements these Terms and controls if inconsistent.

10. Home Devices

Home Devices are intended for the uses described in their approved materials. Do not use a Home Device in a continuous shared or commercial setting unless ML-Star confirms that use in writing. Hygiene, safety and personal-care considerations may limit returns after opening or use.

11. Delivery and Risk

Delivery is governed by the Shipping Policy and any product-specific order. Inspect shipments promptly. For freight deliveries, note visible damage on the carrier record before acceptance where reasonably possible. Risk of loss and title pass as stated in the written order or, if not stated, upon confirmed delivery to the address provided, subject to nonwaivable law.

12. Returns and Refunds

Returns, cancellations and refunds are governed by the Refund Policy and any written professional order. A warranty claim is not the same as a change-of-mind return.

13. Limited Warranty

Eligible products are covered only under the ML-Star Limited Lifetime and Standard Limited Warranty Program available at /pages/limited-lifetime-warranty. Direct ML-Star purchases receive automatic Limited Lifetime Warranty coverage; qualifying Authorized Reseller purchases require registration within 30 days after delivery. The complete warranty, schedules, exclusions and claim process control over summaries elsewhere on the site.

14. Installation, Training and Site Conditions

Installation, commissioning and training are included only when stated in writing. You are responsible for accurate site information, access, electrical capacity, structural suitability, permits, network access, ventilation, sanitation and other facility conditions unless ML-Star expressly accepts responsibility in writing.

15. Maintenance and Repair

Follow the applicable maintenance instructions. Damage caused by omitted, inadequate or improper maintenance, unauthorized alteration, improper repair or incompatible components may be excluded from warranty coverage. Nothing requires a consumer to purchase a named service or part to preserve coverage where such a requirement is prohibited by law.

16. Website Tools and Estimators

Any calculator, business-case tool or estimate uses information entered by the user and is illustrative only. It does not predict demand, revenue, profitability or payback and is not financial, accounting or business advice.

17. Forms and Communications

When you submit a contact, consultation, demo, priority-list, registration, support or partner form, you authorize us to use the information to respond, administer the request, provide service and maintain records. Marketing email or text messages require the applicable consent and may be withdrawn as described in the Privacy Policy.

18. Intellectual Property

The site, brand names, designs, text, images, videos, product materials, software and other content are owned by or licensed to ML-Star and are protected by law. You may use them only for personal or authorized business evaluation. No license is granted to copy, modify, scrape, resell, reverse engineer or create derivative materials except as permitted by law or written authorization.

19. Reviews, Submissions and Feedback

If you provide feedback, reviews, photos or other content, you represent that you have the right to provide it and that it is accurate and lawful. You grant ML-Star a nonexclusive, worldwide, royalty-free license to use the content for operating and promoting the business, subject to the Privacy Policy and any separate written permission required for endorsements or identifiable patient/client content.

20. Third-Party Services and Links

Third-party sites, payment processors, carriers, scheduling tools, analytics, social platforms and other services have their own terms and privacy practices. ML-Star is not responsible for third-party content or services, except as required by law or expressly agreed in writing.

21. Prohibited Use

You may not use the site or products unlawfully; make false claims; infringe rights; introduce malicious code; interfere with security; scrape or automate access without permission; impersonate another person; submit fraudulent information; resell without authorization; or use products contrary to approved instructions.

22. Disclaimer of Site and Non-Warranty Services

EXCEPT FOR THE EXPRESS WRITTEN WARRANTY AND RIGHTS THAT CANNOT BE EXCLUDED, THE SITE, CONTENT, CONSULTATIONS AND NON-WARRANTY SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ML-STAR DISCLAIMS OTHER EXPRESS OR IMPLIED WARRANTIES RELATING TO THE SITE OR SERVICES.

23. Commercial Insurance

ML-Creative Group LLC (DBA ML-Star) maintains commercial general liability insurance, including products-completed operations coverage. Current coverage is evidenced by Certificate of Liability Insurance No. 362980637, issued in connection with Policy No. NXTRPR3JHX-00-GL, for the policy period April 5, 2026 through April 5, 2027.

Evidence of current coverage may be made available upon reasonable request to qualified customers, commercial partners or contracting parties.

The certificate and any stated limits are provided for informational purposes only. Insurance coverage remains subject to the applicable policy, endorsements, exclusions, conditions, deductibles and limits, and does not expand, replace or modify any warranty, indemnity, refund right, limitation of liability or other contractual provision.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ML-STAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, LOSS OF USE OR DATA, OR SUBSTITUTE EQUIPMENT. ML-STAR’S TOTAL LIABILITY ARISING FROM THE SITE OR A TRANSACTION WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, EXCEPT WHERE LAW REQUIRES OTHERWISE.

25. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless ML-Star and its personnel from third-party claims arising from your unlawful use, unauthorized claims, breach of these Terms, misuse of a product, violation of another person’s rights, or acts beyond the approved product instructions, except to the extent caused by ML-Star’s negligence or other liability that cannot be excluded.

26. Force Majeure

ML-Star is not liable for delay or failure caused by events beyond reasonable control, including carrier disruption, supplier delay, shortages, labor disputes, government action, public-health events, natural disasters, power or network failure, conflict or import/export interruption. We will use reasonable efforts to communicate and resume performance.

27. Governing Law and Venue

These Terms are governed by Florida law, without regard to conflict-of-law rules, except where mandatory consumer law applies. Any proceeding not subject to a mandatory alternative forum will be brought in the state or federal courts located in Miami-Dade County, Florida, and the parties consent to that jurisdiction and venue.

28. Severability, Waiver and Entire Agreement

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. These Terms, the applicable policies, warranty and written order form the entire agreement for the subject matter, replacing prior inconsistent discussions.

29. Changes

We may update these Terms prospectively. The version presented when an order is accepted governs that order unless a later change is more favorable or accepted in writing. Continued site use after an update constitutes acceptance for future use, not a retroactive reduction of accrued rights.

Refund and Cancellation Policy

1. Scope

This Policy applies to purchases made directly from ML-Star. Purchases from an Authorized Reseller are subject to that seller’s return policy, while warranty eligibility remains governed by the ML-Star warranty terms.

2. Home Device Change-of-Mind Returns

An eligible Home Device may be requested for return within 15 calendar days after confirmed delivery. To qualify, the product must be unused, unaltered, clean, complete and in original condition with all components, cables, guides, accessories, packaging and proof of purchase. Opened or used personal-care products may be ineligible for change-of-mind return for hygiene and safety reasons, except for a verified defect or a right that cannot legally be excluded.

3. Professional Systems

Professional Systems, including Lumina, Antares and Juno, are commercial or specialized products and are not eligible for change-of-mind return unless the written order expressly states otherwise. Lumina orders are noncancelable and nonreturnable after production allocation, customization, shipment, installation scheduling, delivery or training, except for covered defect, shipping error or mandatory legal right.

4. Cancellations Before Fulfillment

A request to cancel must be made promptly. An order may be canceled without charge only if ML-Star confirms that fulfillment, allocation, procurement, customization, freight booking or other committed cost has not begun. Otherwise, reasonable documented costs, nonrefundable deposits or cancellation charges stated in the order may apply.

5. Return Authorization

Contact sales@ml-star.com before returning any item. Do not ship a return until ML-Star issues written authorization and instructions. Unauthorized returns may be refused or returned at the sender’s expense.

6. Return Shipping

For an approved change-of-mind return, the purchaser is responsible for secure packing, tracking, insurance and return shipping. If ML-Star confirms that it shipped the wrong product or that the product arrived with a covered defect, ML-Star will provide or reimburse reasonable standard return shipping approved in advance.

7. Freight Damage and Delivery Issues

Inspect the shipment promptly. For visible freight damage, note the damage on the carrier’s delivery record and photograph it before unpacking where reasonably possible. Report damage, missing items or shipping error as soon as practical, preferably within five business days. Failure to report promptly may make carrier recovery more difficult but does not eliminate warranty or statutory rights that cannot be waived.

8. Inspection and Deductions

Approved returns are inspected. ML-Star may deny a return or deduct a reasonable amount for missing components, damage, contamination, alteration, excessive handling, use or diminished value not caused by an original defect. Any deduction will be explained.

9. Refund Timing and Method

If a refund is approved, ML-Star will initiate it to the original payment method within ten business days after inspection and final approval. Financial institutions may require additional processing time. Original expedited shipping, installation, training, freight, payment-processing costs or other completed services are not refundable unless required by law or caused by ML-Star error.

10. Promotions and Discounts

A discount or coupon does not remove warranty or mandatory legal rights. An approved refund is based on the amount actually paid for the returned product, less permitted deductions.

11. Warranty Claims

A defective product is handled under the ML-Star Limited Lifetime and Standard Limited Warranty Program. Warranty remedies may include repair, replacement or credit and are not automatically the same as a return or cash refund.

Shipping, Freight and Delivery Policy

1. Service Area

Standard online shipping is available within the United States. Delivery outside the United States requires prior written approval and may be subject to separate taxes, duties, import requirements, service limitations and warranty logistics.

2. Home Devices

In-stock Home Device orders are generally prepared within one to three business days. Transit estimates shown at checkout or provided by a carrier are estimates, not guarantees. Preorder, priority-list, backorder or inventory-constrained products ship according to the written availability notice.

3. Professional Systems

Professional System timing, freight, delivery, installation and training are stated in the written quote or order. Lead times may depend on allocation, configuration, documentation, site readiness, freight capacity and other project requirements.

4. Lumina Freight and Site Coordination

Lumina is delivered through coordinated freight or another method selected by ML-Star. The purchaser must provide accurate access details, loading conditions, doorway and elevator dimensions, floor level, site contact, electrical information and other requested site data. Unless the order states otherwise, construction, electrical work, structural modification, permits, rigging, stairs, cranes, storage and extraordinary access are not included.

5. Installation and Training

Lumina installation and on-site training are organized by ML-Star as described in the order. Other products include only the installation, demonstration or training expressly stated in writing. Delivery alone does not imply that construction, facility preparation or ongoing maintenance is included.

6. Address Accuracy and Changes

The purchaser must provide a complete and accurate delivery address and contact details. Address changes are not guaranteed after processing begins. Additional carrier charges caused by an incorrect address, missed appointment, refusal, inaccessible site, redelivery or storage may be charged to the purchaser.

7. Delivery Inspection

Inspect packages and freight promptly. Note visible freight damage on the delivery record where reasonably possible and take photographs before removing packaging. Contact ML-Star promptly regarding damage, missing items or incorrect products.

8. Lost or Delayed Shipments

Contact ML-Star if tracking does not update or a shipment appears lost. We will work with the carrier, but carrier investigations and replacement timing may vary. ML-Star is not responsible for delay caused by carrier events or circumstances beyond reasonable control, except as required by law.

9. Risk of Loss

Unless a written professional order states otherwise, risk of loss passes upon confirmed delivery to the address provided, subject to mandatory law. If the purchaser authorizes unattended delivery, special placement or another delivery exception, the associated risk may pass when the carrier completes that instruction.

10. Warranty Shipments

Shipping for warranty diagnosis or repair is governed by the ML-Star warranty, not this standard delivery policy. Do not ship a product for warranty service without written authorization.
